PRIVACY NOTICE ON THE PROCESSING OF PERSONAL DATA – KVK
1. Introduction
The Personal Data Protection Law No. 6698 (“KVK Law”) was published in the Official Gazette dated 07.04.2016 and numbered 29677, and entered into force on that date. This Law aims to ensure that personal data is processed and protected in accordance with contemporary standards. In this context, the Law regulates the conditions for processing personal data, the principles that safeguard individuals’ fundamental rights and freedoms, and the procedures and principles that data controllers must comply with.
Our Company, as the organization carrying out the BİYAPAYZEKA project, is obliged to fully comply with the KVK Law. All personal data processed within our operational processes is collected, processed and protected within the framework of the relevant legislation.
2. Data Controller and Our Responsibilities
Our Company (Company Title: “BRITISH INSTITUTE YABANCI DİL KURSLARI”), which brings to life and operates the BİYAPAYZEKA project, takes the necessary administrative and technical measures to protect your personal data in its capacity as data controller.
3. General Principles in the Processing of Personal Data
Our Company processes the personal data it handles within the scope of BİYAPAYZEKA in accordance with the principles set out in the KVK Law:
- Being lawful and in accordance with the rules of good faith,
- Being accurate and, where necessary, kept up to date,
- Being processed for specified, explicit and legitimate purposes,
- Being relevant, limited and proportionate to the purposes for which they are processed,
- Being retained for the period stipulated in the relevant legislation or required for the purpose for which they are processed.
4. Methods of Collecting and Processing Personal Data
In connection with the products or services offered by the BİYAPAYZEKA project, your personal data may be;
- Collected through automatic or non-automatic methods,
- Collected through channels such as our Company’s or our business partners’ offices, branches, dealers, call centers, websites, social media, mobile applications, etc.,
- Collected verbally, in writing, or electronically.
In addition, your personal data may also be processed when you call our call center, visit our website, or attend trainings, seminars, organizations and meetings held by our Company in order to benefit from BİYAPAYZEKA services.
5. Legal Basis for the Collection of Personal Data
Your personal data is obtained;
- In order to provide the products and services offered within the scope of the BİYAPAYZEKA project in accordance with the contract and legal legislation,
- In order to ensure that our Company fulfills its contractual and legal obligations accurately and completely.
Your personal data collected for these purposes may be processed and transferred for the purposes below, within the framework of the data processing conditions specified in Articles 5 and 6 of the KVK Law.
6. Purposes of Processing Personal Data
Within the scope of the BİYAPAYZEKA project, your personal data may be processed primarily for the following purposes:
- Improving the services provided, developing new services, and providing information related thereto,
- Carrying out campaigns, service promotion and marketing for existing customers and prospective customers who have given consent for commercial electronic communication,
- Resolving customer (user) issues and complaints,
- Conducting statistical evaluations and market research,
- Determining and implementing the Company’s commercial and business strategies,
- Managing relationships with member merchants and business partners,
- Tracking accounting and payment transactions,
- Legal processes and compliance with legislation,
- Responding to information requests from administrative and judicial authorities,
- Planning internal reporting and business development activities,
- Carrying out financial control and reporting activities, and making legal notifications,
- Managing internal control and audit processes,
- Ensuring information and transaction security and preventing malicious use,
- Making arrangements to ensure that the processed data is kept up to date and accurate.
7. Transfer of Processed Personal Data
When necessary, our Company may share your personal data within the scope of the BİYAPAYZEKA project with;
- Our domestic/international business partners,
- Our member merchants,
- Related parties such as banks, financial institutions, independent audit firms,
- Authorized persons and institutions within the framework of the Law on Payment and Securities Settlement Systems, Payment Services and Electronic Money Institutions and related legislation
This transfer will be carried out in accordance with the data processing conditions specified in Articles 8 and 9 of the KVK Law.
Under legal legislation, documents and records related to transactions may need to be retained for certain periods. In this context, even if you request the deletion of your personal data, such data may continue to be retained due to legal obligations until the relevant statutory retention period expires; during this period, your data will not be processed for any purpose other than legal obligations and will not be shared with third parties.
8. Rights of the Personal Data Owner Under Article 11 of the KVK Law
As personal data owners, you have the following rights:
- To learn whether your personal data is being processed,
- To request information if your personal data has been processed,
- To learn the purpose of processing your personal data and whether it is used in accordance with its purpose,
- To know the third parties to whom your personal data is transferred, domestically or abroad,
- To request the correction of your personal data if it has been processed incompletely or incorrectly, and to request that this correction be notified to the third parties to whom your personal data has been transferred,
- Even if processed in accordance with the KVK Law and other relevant legal provisions,
- To request the deletion or destruction of your personal data if the reasons requiring its processing no longer exist,
- To request that this action be notified to the third parties to whom your personal data has been transferred,
- To object to the emergence of a result against yourself by analyzing the processed data exclusively through automated systems,
- To request compensation for damages if you suffer damage due to unlawful processing of your personal data.
9. Exercising Rights and Application Procedure
Pursuant to paragraph 1 of Article 13 of the KVK Law, you may submit your request regarding the rights specified above to our Company in writing or through other methods determined by the Personal Data Protection Board (“Board”). Since no additional method has been determined by the Board at this stage, applications must be submitted in writing.
To exercise your rights regarding data processing activities within the scope of BİYAPAYZEKA:
- You may fill in the application form available at https://britishtr.com/,
- You may send a signed copy of the form, together with documents proving your identity, in person or by registered mail with return receipt to “BRITISH INSTITUTE YABANCI DİL KURSLARI, LATİLOKUM SOKAK NO:2/15-16 MECİDİYEKÖY – ŞİŞLİ/İSTANBUL 34381”,
- You may submit your request through a notary public or by other methods specified in the KVK Law,
- You may submit your application with a secure electronic signature to info@british.com.tr.
Our Company will conclude the application free of charge within 30 days at the latest, depending on the nature of the request. However, if the Personal Data Protection Board sets a fee schedule, our Company may charge the fee specified in that schedule.
In conclusion, your personal data processed within the scope of the BİYAPAYZEKA project is processed, stored and protected in full compliance with all legislation and the provisions of the KVKK.
