DISTANCE SALES AGREEMENT

This agreement governs the terms and conditions for distance sales made through the “Language Education Package” (an online education service developed and offered by British Institute Foreign Language Courses). By approving this agreement, the parties are deemed to have accepted the rights and obligations set out below.

1. Rights and Obligations of the Consumer

The Consumer (Buyer) is obliged to provide accurate and complete information about themselves and the product/service they wish to purchase (education packages, digital content, online courses, etc. within the Language Education Package). To benefit from the best quality of service, the Consumer must fully fulfill all responsibilities imposed by this agreement.
The Consumer is obliged to comply with the payment plan and schedule specified in the distance sales agreement.
If the Consumer purchases a physical product, they must inspect the product upon delivery and notify the seller (British Institute) of any defects without delay. However, used products are not eligible for return.
The Consumer is responsible for making the necessary notifications regarding damage or other matters imposed by the agreement.

2. Order and Sales Terms

British Institute (our Company) will process orders placed during business hours (weekdays 08:30-17:30) on the same day; orders received after 18:00 will be processed during the business hours of the following business day.
The Consumer accepts and declares that all information provided when placing the order is accurate and complete, and that they may be contacted via the phone number and email address specified in the order information.
Once an order is successfully completed, our Company will send a notification message to the Consumer’s provided email address confirming that the order has been completed.

3. Order Cancellation

The Consumer may cancel their order before the username and password are delivered. In such cases,
simply notify your cancellation request via email to info@british.com.tr. Once the relevant request is reviewed, the payment will be refunded within 2 to 20 days.

4. Payment

Payments for orders placed through the Language Education Package can be made using credit cards from any bank, wire transfer, or similar methods. The order is considered processed at the moment the payment amount reaches the company’s account or is charged to the credit card.
The Consumer is obliged to pay the fees and legal taxes required to use the Language Education Package service.
A secure connection via the SSL protocol is provided during credit card transactions. There is no refund for amounts collected following provision approval, except in cases of force majeure.
All product/service prices stated on the site include VAT.
If the Consumer is a commercial company, the invoice will be issued in accordance with the relevant company’s information; if the Consumer is a natural person, the invoice will be issued in their name.
Once the payment made by the Consumer is successfully confirmed following provision approval, our Company’s obligation to complete the order arises.
Our Company reserves the right to change its pricing policy at any time for some or all of the services offered within the Language Education Package. Changes take effect as soon as they are announced on the site.
Our Company is not responsible for pricing errors resulting from typographical or system errors.

5. Provisions Regarding Delivery

Digital products or services ordered through the Language Education Package (such as online education, username/password, etc.) will be assigned to the user within 15 days at the latest, and notification will be sent to the email address specified during the order. Our Company reserves the right to extend this period by 5 more days, provided prior notice is given.
It is the user’s responsibility to ensure that the email address declared for delivery is accurate and complete. British Institute cannot be held responsible for any disruptions arising from incorrect or incomplete declarations.
Provided there is a justified reason, our Company may offer an alternative service of equal quality and price instead of the service subject to the agreement, or, in cases where fulfilling the order becomes impossible, may notify the Consumer and refund the amount paid within 2 to 20 days.
If the Consumer fails to fulfill the conditions specified in the agreement, our Company shall not be responsible for the non-delivery of the product/service.

6. Provisions Regarding the Right of Return

Under Law No. 6502, “services performed instantly in electronic form” (such as instantly downloadable software, e-books, password-protected online courses on the web, etc.) are not subject to the right of withdrawal. The nature of the services offered under the Language Education Package is generally online and instant access. Nevertheless, British Institute, prioritizing user satisfaction, may grant the Consumer the right to apply for a return within 14 days from the moment the product is delivered (i.e., from the moment active access is provided via username/password).
- A written return request must be sent to info@british.com.tr within 14 days following payment.
- If the request is approved, the remaining amount will be refunded within 2 to 20 business days, after deducting an operation fee (for example, 250 TL for cash orders, 295 TL for credit card transactions).
- Return requests made after 14 days or through different communication channels will not be considered.
If the Consumer returns the product, they must also return all copies of the invoice in their possession.
The refund amount will be delivered to the Consumer within 2 to 20 days. Our Company is not responsible for delays occurring in the bank’s or financial institution’s processes.

7. Consumer Rights – Withdrawal – Cancellation – Return Terms and Conditions

Consumers who place orders electronically through the Language Education Package are deemed to have accepted the distance sales agreement along with the pre-information form provided to them.
Buyers are subject to the provisions of Law No. 6502 and related regulations.
The purchased product/service will be delivered to the person/organization at the address specified by the Buyer, or digital access will be assigned, within the legal period of 30 days at the latest. If this period is exceeded, the Buyer may terminate the agreement.
The purchased product/service will be delivered in accordance with the characteristics specified in the order and any applicable warranty documents.
If it becomes impossible to sell the product, the seller is obliged to notify this in writing within 3 days of becoming aware of the situation, and to refund the amount paid within 2 to 20 days.

7.1. If the Purchased Product Fee Is Not Paid

If the Buyer does not pay for the product or the payment transaction is cancelled, the Seller’s obligation to deliver the product ceases.

7.2. Purchases Made Through Unauthorized Use of Credit Card

If, after the product is delivered, it is determined that the buyer’s credit card was used by unauthorized persons, and the relevant bank/financial institution does not make payment to the seller, the buyer must return the product to the seller within 3 days.

7.3. If the Product Cannot Be Delivered on Time Due to Unforeseen Reasons

If the Seller is unable to make delivery due to force majeure, it will notify the Buyer of this situation. The Buyer may cancel the order, request an exchange with a similar product/service, or request that delivery be postponed until the obstacle is removed. If the order is cancelled, the fee will be refunded within 2 to 20 days if paid in cash, or refunded to the bank within 2 to 20 days if paid by credit card. It may take the bank 2-3 weeks to transfer the amount to your account.

7.4. Right of Withdrawal

Although “services performed instantly in electronic form” are, as a rule, not subject to the right of withdrawal, British Institute, due to its confidence in the quality of the Language Education Package product, grants the consumer the right to a refund within 14 days from the purchase date, provided the consumer has not yet received the product (i.e., the username/password has not been activated).

To exercise this right, the Consumer must send a written notification to info@british.com.tr.
If the return is accepted, the remaining amount will be refunded within 2 to 20 business days, after deducting an operation fee of 10%.
Return requests made after 14 days or through different channels will not be considered.

7.5. Duration of the Right of Withdrawal

If a purchased item is a service and the buyer has not accessed this service (i.e., service delivery has not taken place), the right of withdrawal is valid for 14 days following the date the service agreement was signed.
All costs arising from the exercise of the right of withdrawal shall be borne by the buyer.
To exercise the right of withdrawal, written notification must be given to the seller within the specified 14-day period, and the service/product must be unused or cancellable.

7.5.1. Use of Discounts/Gift Vouchers

For orders placed using a special discount code or gift voucher from the list price, the return period voluntarily granted by the company may be applied as 7 days.

7.5.2. 30-Day Limit

In all cases, the return request must be made within a maximum of 30 calendar days after the order date. Otherwise, the return process will not be applied.

7.6. Exercise of the Right of Withdrawal

The invoice, return form, and any standard accessories of the product to be returned must be sent complete and undamaged.
For returns of orders invoiced to institutions, a return invoice must be issued by the institution; otherwise, the return cannot be completed.

7.7. Return Conditions

The Seller is obliged to refund the total amount to the BUYER, after deducting a 10% operation fee, and to take back the product within 2 to 20 business days at the latest after the withdrawal notice reaches them.
British Institute is not responsible for delays arising from situations such as the Consumer sending the invoice late or failing to provide IBAN information.
If a decrease in the value of the goods/service or an impossibility of return occurs due to reasons attributable to the BUYER’s fault, the BUYER is obliged to compensate for this loss.
For returns that would bring the amount below the campaign threshold, the discount provided under the campaign will be cancelled.

7.8. Products Not Eligible for the Right of Withdrawal

The right of withdrawal cannot be exercised for services performed instantly in electronic form, digital content, audio/video recordings, or in cases where the packaging of a book/e-book/course, etc. has been opened or online access has been granted.
The purchased education is considered as a whole package and is indivisible. Differences between levels or courses do not imply that the education is divisible.

8. Default and Its Legal Consequences

If the BUYER defaults on a purchase made by credit card, they accept that they will pay the interest and expenses in accordance with the provisions of the credit card agreement. In this case, the BUYER also undertakes to compensate British Institute for any resulting losses.

9. Payment and Delivery

Buyers who wish to pay by bank transfer or EFT can use the following IBAN number in the name of British Institute Yabancı Dil Kursları:

Payment can be made for the Language Education Package or through the website by credit card, either as a single payment or in installments. The charge is processed via credit card at the end of the order.

The Buyer (Consumer) accepts, declares, and undertakes that they have read, understood, and approved all the terms of the agreement, and that they have signed the agreement by giving the necessary approval electronically. This agreement takes effect the moment it is approved electronically by both parties.
